Selling a Condo in Washington? Avoid the 2026 Seller Trap

If you plan on selling a condo in Washington in 2026, your old condo rules from the 90’s or what are called “Legacy” rules might be a liability. As of January 1st, new state laws now apply to every community. These rules, known as WUCIOA, affect all associations regardless of age. Specifically, you must ensure your community follows these new standards to protect your equity.

The Danger of the “Old” Resale Certificate

In 2026, the buyer’s “Right of Rescission” is their strongest weapon. Consequently, an outdated Resale Certificate can ruin your closing. If your Association provides an old form, it might miss the new 2026 mandates. For example, the form must now disclose no-fee payment options and interest-bearing reserve status. If these are missing, the buyer can legally walk away with their full deposit. Therefore, you must verify your documents early in the process.

Why the “15-Minute Rule” Matters

Does your Board still vote behind closed doors? Under the new law (RCW 64.90.445), every meeting must include a 15-minute owner comment period. Furthermore, the Board must hold this period before they cast any votes. If your Board skips this step, their decisions are not legally sound. As a result, lenders may find “title clouds” and refuse to fund the buyer’s loan. When selling a condo in Washington, this can stall your sale and scare off serious buyers.
